Dear Sir/Madam,
I would be very glad if you could assist me with a problem that I am currently facing professionally.
I attended an interview at a retail store, and I got selected to work at the store. They called me in to offer me a 0h-contract and said that I had to sign on the spot if I wanted the job. I admit I should’ve just run away, but I made a mistake and I signed their contract (which is valid for 150 days - 5 months).
I’ve had many work contracts in the Netherlands before and I was certain that, since I would be their new employee (and thus I wouldn’t benefit from an extension of an existing contract) there would be a probationary period in place. I’ve had this with every other contract, only the time period would differ (sometimes 2 weeks, most of the times 1 month). However, although the contract states they offer a 2-month probationary period, they only offer it for contracts longer than 6 months (again, mine is 5 months).
After reconsidering my employment options, I decided not to pursue their offer and handed in my resignation letter. This came with a 1 calendar month notice, so I would still be their employee until the 31st of July. Because they schedule all their employees 3 weeks in advance and they had already scheduled me, I told them I would come to work for the time I got scheduled, but I also asked them not to schedule me anymore after the 3 weeks (which would end with the 1st week of July).
The general manager of the store arrogantly said he doesn’t care about it and he will keep scheduling me, forcing me to come to work, even though I told them I don’t want to work for them. I tried multiple times to ask him to meet me halfway, but he said he said he would take legal action if I don’t come to work.
After hearing this, I realized I don’t want to be a part of that place. I got advised from a friend that works in HR to call in sick on my first day, which I did (this was Sunday, 16th of June). On the phone, the store told me that their rule is to call in sick every day of my absence (even for the days when I am off), and this is what I’ve been doing for the past few days.

In case you consider yourself ill, the employer in principle has to respect that, but he is entitled to send you to a company doctor (bedrijfsarts) to obtain a medical opinion whether or not you are fit for work. To check whether or not the legal notice period has been respected by you, your employment contract and your notice letter should be studied.
