We had a contact with a construction company to come do some repairs in our house. We paid 30% up front and 60% after we got the second bill. The contact stated that we pay 10% after completion of the work. One morning, the owner of the company called us and said he has to start working for us because the wife had a heart attack and he has to take care of his kids.

My husband said ok, can you get some one to finish your job. He left and two days later, he said he could not find anyone. My husband look for someone who asked for €1700 to complete his job. We informed him and he said that was too expensive. A day after, we got a bill of €800 from him saying. I think it will cost you €600 to complete my job.

We were against the bill and told him we got no time to wait for someone who will come finish your job for 600 because we already have appointments with another company to do the laminate and the stairs of our house. His job was to be completed before the others. So we got no time. Normally his balance of 10% was €1650 to be paid after completion of the job.

So we informed him that we are going to use the money to pay for the completion of his job.

One week later, we got his bill of €800 from the incassobureau!!!!

What can we do?

You must communicate in written legal notes. Say the constructor has breached the contract , given the fact he cannot find another constructor and so now you have to assign the job to a third professional party on his account. Plus he is liable for damage like extra free days at home and the difference between his bill and the other one. Put a chronical line in the note with facts and dates.
