They assume my parents put it in a savings account.
This is not the case and I cannot prove it and am therefore not entitled to assistance at this time.

I have already told the social services that they can add that amount (which I had to pay back to my parents) to my assets, because the point is that they have to calculate my assets
But they need a statement from my son's (non-existent) savings account.

Until then, I am not entitled to benefits.

Is it true that if I hand in everything, show that the money has been transferred to my parents' account, and indicate that they can add that amount to my assets, I am not entitled to benefits?

If I had simply spent that amount on buying new stuff, going out, etc., they wouldn't have made a fuss about it.
But because I clearly explained how everything happened, the reason and provided all the evidence, they are now making things difficult.

What is the best thing I can do about this?

Thanks in advance for your response.

Lawyer

The problem is likely caused by the benefits agency adding the money from your son's savings account to your assets. This is also justified under property law, because it belonged to your son and you managed it for him.

In the eyes of the benefits agency, you acted suspiciously by paying the money to your parents—unnecessarily—just before or during your application. Therefore, the benefits agency always checks back to determine whether any money has been "spilled away." In such a case, benefits are denied until you have "used up" the amount for your living expenses. Incidentally, if you had spent the amount on other things, the benefits agency would have reacted in the same way.

Check with your benefits agency for the best course of action in your current situation. If you can't figure it out, request a written rejection (you may already have received one) and then appeal it within six weeks.

I recommend that you consult a lawyer before filing an objection. You can obtain subsidized legal assistance from lawyers on this website, a legal aid clinic or law firm near you, or the Legal Aid Desk (0900 8020).

https://www.rechtswinkel.nl/en/products/vragen-22106-ik-heb-een-aanvraag-ingediend-voor-bijstand-ik-moest-alle-afschriften-van-mijn-spaar-rekeningen-d
