Your rights and obligations

Questioner

Dear Sir/Madam,

I rent a studio in a building where there are multiple studios. The landlord has asked for fire safety reasons to remove all items in the hallway and stairwell.

These items were not placed there by me, but by other tenants who left years ago or by existing tenants who are difficult to contact.

Now my landlord announces that they will come and remove the stuff themselves at the tenants' expense.

My question is: can they send this bill to the tenants? My lease does state that they can remove stuff without prior notice, but nothing about the costs of that. I have been renting the studio for 6 years, they never checked before that.

Lawyer

Good morning, thank you for your question. The previous tenants apparently left, leaving behind items. You have started renting and are obliged to comply with government regulations regarding the use of the rented property. If this means that the common hallways and stairs must be kept clear, you are obliged to remove these items - even if they are not yours. If you do not do so, the landlord is authorised to remove the items at your expense.

Questioner

Thank you for the advice.

https://www.rechtswinkel.nl/en/products/vragen-23490-geachte-meneer-mevrouw-ik-huur-een-atelier-in-een-gebouw-waar-meerdere-ateliers-zijn-de-verhuur
