Income has been busy for a long time with the request to remove the old junk and put something decent there. What is there now can no longer be called planting. The municipality does not want to do this, but it is the face of my home (property). What can I do about this?

Lawyer

You can always ask the municipality if you can maintain the garden from now on. You may also expect the garden to be maintained so that it is not overgrown with weeds but apparently that happens too but you do not like the plants.

Questioner

I can maintain it myself, but then I have to rent it. Firstly, I can't afford that as a single mother. And secondly, I don't have time for that, because I work more than 40 hours a week. This has to do with the fact that I have a 3-hour travel allowance per day. That's why I want the municipality to do this. The planting is no longer planting, but undergrowth with stuff that has blown in through it. What was originally there was already planted before I bought this house in 1983, but there is nothing left of that now.

Questioner

Is there no way to get the municipality to make this decent again? As a citizen I have duties, but the municipality also has duties towards the citizens. This affects my living pleasure and the value of my home will decrease. I have also suggested that they put grass in it. I want to get the lawnmower over it myself. That is not that much work, but they do not want that either. According to them it will remain as it is. That is why I ask whether there are possibilities to enforce this.

Lawyer

The question is whether the municipality is acting unlawfully by (a) not managing the piece of land (properly) and (b) not allowing you to keep the piece of land tidy yourself. Unlawfulness will not be found quickly. The municipality owns the land and can therefore decide for itself how it manages it. This will only change if you experience serious inconvenience due to the lack of maintenance. That does not seem to be the case here. You do not like the look of it, but it does not cause serious inconvenience.

In this state of affairs, you cannot force the municipality to properly maintain this piece of green space.

Lawyer

First of all, it is always useful to file a complaint with the municipality, preferably in writing. If that does not work, you can always approach one or more political parties. They can then address the municipality about their failure.

https://www.rechtswinkel.nl/en/products/vragen-3436-voor-mijn-huis-ligt-een-gemeentetuintje-dat-al-jaren-niet-naar-behoren-wordt-bijgehouden-inkomen-al
