Either you are a plaintiff in the convention (you are then the one who had the summons issued, so the plaintiff) and a defendant in the counterclaim (your counterparty has filed a counterclaim), or you are a defendant in the convention (your counterparty has issued the summons) and a plaintiff in the counterclaim (you have filed a counterclaim).\n \nI assume that you have issued the summons and are therefore the plaintiff in the principal claim. Your counterparty has responded to this with a Statement of Defence (CvA) and has instituted a claim in reconvention. You have responded in writing to the CvA (that was your statement of reply) and to the claim in reconvention (that was your statement of answer in reconvention). Your counterparty has now responded with a statement of rejoinder in the principal claim (i.e. the response to your response to the CvA) and with a statement of reply in reconvention (i.e. their response to your CvA in reconvention). You now still have the opportunity to respond to the statement of reply in reconvention.\n\n In short, you are going to draw up a 'Conclusion of rejoinder in reconvention'.\n\n As for drafting the piece yourself, only do this if you really know what you are doing.
