Can my employer then also demand that I resign as of December 1st? Or can I determine the end date when I resign myself?

Lawyer

The statutory notice periods as stated in Article 7:672 of the Dutch Civil Code apply to the termination of your employment, unless the parties have made different agreements in advance within the statutory possibilities.

Your employer cannot therefore demand that you resign early. However, your employer can submit a proposal to you, but he is dependent on your agreement to terminate early. You are not legally obliged to agree to a proposal for early termination.

You cannot arbitrarily determine the end date on which you resign without your employer's permission. You can, however, determine the date on which you resign and in this way, taking into account the applicable notice period, determine the final end date (which by law must be at the end of the usual payment period).

https://www.rechtswinkel.nl/en/products/vragen-4258-ik-wil-graag-eind-oktober-mijn-ontslag-indienen-per-1-januari-mag-mijn-werkgever-dan-ook-eisen-dat
