Legal Advice on Trademark Rights and Images
Questioner
Hello, We are an account on the media platform Instagram and are not registered with the Chamber of Commerce. We are working on a clothing line and want to put our logo on our clothes, but it features Johan Cruijff's head. Johan Cruijff's head has been edited and is therefore not the real head of Johan Cruijff. We would like to know if it is allowed to incorporate his head into our logo and produce it on our clothing. We do not want to run the risk of a fine. BvdLawyer
The authors and (image)marks of the physical features of the late J. Cruiff belong to his heirs and or licensees. 100% sure that you will get into trouble if you use that image because you infringe on the portrait and trademark rights. This is because you state that you edit the image in such a way that Cruiff is still recognizable by the public; that is sufficient infringement to claim substantial damages and an injunction.Neem de volgende stap
