Questioner

My partner has gone bankrupt as a natural person and I have had no income since April 2016 Now I am outside the bankruptcy of my partner However, we have decided to deposit the VTLB into my account via the trustee so that all fixed costs can be deducted on time. Now I have a claim and the bailiff has seized my account despite the fact that they know that I have no income. Only the VTLB amount is deposited into my account with a clear description of the trustee bankruptcy and VTLB amount and the month and year. We have shown that this concerns the VTLB of my bankrupt partner. Now the bailiff says that they think it is my money (despite the very clear description) because this is deposited into my account and they see this as income. But they are not allowed to seize a VTLB amount at all and when I say that they get very angry. The bailiff is not amenable to reason, what can I do with this? They refuse to handle a complaint and I also regularly hear that the chamber of judicial officers often does nothing with a complaint. In the meantime we have asked the curator to transfer the VTLB amount to my partner's account and that is now also happening so they can't do anything But this bailiff really thinks he is above the law and can do whatever he wants and I want to do something about that.

It is a well-known story that some bailiffs put themselves above the law. You can file a complaint with the complaints committee of bailiffs. If this does not help, you can hold the bailiff liable for any damage you suffer due to unlawful actions. If desired, you can contact me directly for further advice or legal assistance.
