Questioner

Dear M, My wife and I have a business question. Try to describe the current situation with a short introduction. We took over the riding school from a foundation in January 1993. During the construction of the riding school (mid-1960s), this foundation sought financial support from private individuals by enabling them to purchase horse boxes. These boxes were bought back by the foundation before we took over the company, except from 1 person with whom they could not agree commercially. This was known to us at the time of the takeover. From 1993 until now (23 years) we have had no contact with this person, either physically or administratively. Until last week, when he demanded overdue rent for his horse boxes (2 units) during this period. The question is this. Can this person ask us this after 23 years without any announcement and without a lease agreement? I would like to hear from you Yours sincerely,

Can you explain (preferably via the direct contact option of rechtswinkel.nl) on what basis rent payment is required from you? Who is the owner of the boxes and on what legal title (purchase, easement, leasehold)? If a situation arises in which you can be considered a tenant of the boxes (rent can arise outside of a written contract), then rent payments cannot be claimed for more than five years.
