Assistance with legal holiday issues
Questioner
We previously asked the question about vacation rights. My husband reported his vacation in October 2015, then the company came in December with the request to move the vacation because it did not fit in with the planning. We found this proposal extreme and offered an alternative which was not returned to until mid-June. After asking the question here, it turned out that we were within our rights to allow the requested holiday to go ahead. After some inquiries, the company admitted to making a mistake, but that did not solve the holiday problem. In the end my husband took his vacation as he was told. Minus the very first week, which he let lapse. What was he supposed to do with a week of vacation when the rest of the family is working and in childcare?! It was getting pretty heated and after all, you have to go back to your workplace after the vacation! In the meantime, the 2 weeks are almost over. I had to continue my work the first of these 2 weeks until Wednesday and finish it on Wednesday and Thursday (own company) because of that we were finally able to go on a short holiday with our family on Friday August 5th. The weather in the Netherlands has played a big part in the atmosphere of the past week. Also the fact that we have not had the opportunity to leave because of the reservation for shelter for the animals (try again to find a kennel that has a spot for 2 in the 2nd week of August. We had reserved this for the last week of August. And we had to cancel that.) and the atmosphere in which my husband started his holiday and the unpleasant feeling he has about it. What can we do about this with the employer?? My husband has made concessions, the family has clearly suffered but the employer is not actually doing anything in return. We can claim the costs for unnecessary childcare during my husband's first week of vacation and the reserved care for the animals during the last week, but what about the 2 and a half weeks that we would actually still have with the family?Lawyer
What is then important is what is reasonable. If you have previously agreed, you cannot legally recover the costs. Of course it fell into the water.. But maybe I don't quite understand what amount you want to enter.Questioner
Good afternoon, Thanks for your response. It is not directly about an amount but about the way we now 'have to' spend our vacation. We find it no more than fair that the costs for childcare and animal care are reimbursed. (camping for the last week of August was, I would almost say unfortunately not yet booked) But the fact is that our holiday literally fell through. Perhaps compensation can be found in vacation days. That my husband agreed to this holiday was rather because there was little other choice for him. He was more or less forced into it. And he had to knock on the manager's door himself (at the end of the week of July 18) The promise was that they would look for a solution. In the end, the manager did nothing and let it come to that. We would officially have a holiday from 8 Aug to Tue 30 Aug and within that we would have the freedom to go and stand where we wanted. For that we had also arranged the care of the animals. Now we had a joint 'holiday' from Friday August 5 to Saturday August 13 and were unable to go anywhere.Lawyer
Once you have agreed, there is in principle no legal basis to enforce compensation. The options are therefore available in the case of a goodwill request. You make it clear that you could not have known in advance that this would have such an impact. This provides grounds for requesting compensation vacation days. I would like to send a request with arguments for the employer. That should then move the employer to a solution.Questioner
You'd be very welcome! That would help us a long way if you would like to do that. Kind regardsNeem de volgende stap
