I have been on sick leave for 1.5 years. My employer has offered me a severance package after 1 year. I didn't respond to it in detail because I wasn't mentally capable of it. Now the 2 years are approaching and I'm in doubt about the following: Should I still sit down with my employer for compensation, and am I still entitled to it? Can my employer say now no no longer valid, almost 2 years so you have to make do with a transition payment. (I worked for the company for almost 10 years) Or, accept a transition payment and not sit at the table? And what happens to my income when I receive unemployment benefit (Ww) or disability benefit (WIA)? Thank you very much..Lawyer
After two years of incapacity for work, the obligation to continue paying wages ends and two things can happen: -your employer keeps you employed - in that case you can contact him again when you can work (partly) again - your employer terminates your employment - in that case you are entitled to the transition payment (within 2 months). Sometimes there is reason to negotiate a higher amount. If you end up in the ww or wia your income will drop to 75% and after 2 months to 70% of your last income.
