Day, I have a residential property that I have rented out for a fixed period (1 year) with tacit renewal since June 1st. Now it is so that I can sell the property and the buyer is prepared to wait until this rental year has ended. However, the tenant (private individual) has announced that he wants to stay, even after the first year. I would have liked to sell the property but am now stuck with the tenant, unless I would move in myself (which I do not intend to do). In order to have some guarantee that the tenant will actually rent for a longer period, I have proposed to extend the rental period by two additional years. The tenant agrees to this. Under the condition that the tenant will rent for an additional two years (until May 31, 2019), the rental contract must be reopened and amended. My question: Do I need to draw up a completely new rental agreement for this, or is an addition with a new end date, signed by both parties, also sufficient? Once this new contract has entered into force, the tenant is bound by the contract for the period up to 31 May 2019 and the lease cannot be terminated prematurely? Does the right to continue living as a tenant automatically expire after the date of May 31, 2019 or can the tenant continue living thereafter? You have, you write, concluded a rental contract for a fixed period, namely one year. In that case, you may simply terminate the rental in good time? What does the contract state and from when does it run, from 2015/16?
