Dismissal and holiday pay: Your rights

Questioner

My employer does not want to pay out my vacation hours because, according to him, I have unilaterally breached the contract. I resigned on August 1st and in consultation with him it was decided that I would work 4 more weekends with his permission if I started with my new employer during the week. I left the weekends open for him. Then he scheduled me out of the weekends, even though they had already been scheduled with services for a long time. After watching this for weeks, I called him and told him that I would not be coming the last agreed weekend because he had done all this without consultation. Now he doesn't want to pay out my vacation hours (46). Can this

Lawyer

No, that is not allowed. All of this was discussed with mutual consent. That your employer suddenly changes the agreed schedule for his own gain is abuse of the law and is not permissible. If desired, you may contact me directly for further information or for legal assistance.
