Legal advice on claims for damages
Questioner
my question is about this situation a colleague of mine his phone screen broke that happened in this way he had put his phone on his mountain bike saddle. Because he wanted to get something from his bag in the meantime at that moment I also grabbed my own bike then unconsciously tapped his rear wheel very softly with my own front wheel which resulted in his screen breaking. I did not know at that moment that there was a phone on it. Now my colleague is forcing me to pay does he have the right to do this? Thanks in advance for your adviceLawyer
No, the law assumes in the beginning that everyone bears his own damage. There must be something special going on to be able to hold someone else liable for this. That other person must have made a mistake other than a common game or sports accident. In the case you describe, the colleague himself is responsible because he accepts the chance that his mobile phone will fall of itself, through his own or someone else's movement if he puts it in an unstable and unexpected place.Questioner
