My dog has been confiscated after a biting incident and will be tested. Received a message from the District Public Prosecution Service, Seizure Office, with the following text: 'Given the high costs of custody, I intend to issue an authorization pursuant to Article 117 of the Code of Criminal Procedure for alienation. Article 117 paragraph 1 of the Code of Criminal Procedure stipulates that seized objects may not be alienated, destroyed, surrendered or used for a purpose other than the investigation in the interim, unless authorisation has been granted to do so. However, according to Article 117 paragraph 2 of the Code of Criminal Procedure, the Public Prosecution Service may grant authorisation for interim alienation with respect to the following objects: - objects that are not suitable for storage; - objects whose storage costs are not in reasonable proportion to their value value; - items that are replaceable and the equivalent value of which can be easily determined certain. The authorization only includes destruction if the uncontrolled possession of the object is contrary to the law or the public interest.
