Good afternoon, I have lived in my current home (new-build home) in a new neighborhood since June 2006. My next door neighbor has planted two trees in her garden, the trees are only getting bigger so I can't enjoy the sun much. I have asked my neighbor several times if she could prune her trees even shorter so I won't have any trouble there. These trees planted not even a meter away from the garden border. our gardens are 4.5 meters wide and she planted these trees side by side in width. The branches of the tree also come over our fence into my garden. In addition, she has planted trees near the fence and she lets them grow half a meter higher than our garden fence, which means that 1) I have a lot of trouble with the leaves that are all over my garden, and 2) it also keeps out the sun there. I have three cats myself and she is not really a cat person with names. When I ask her to prune her trees she immediately says what I am going to do with my cats!! And that I can then sit in the back of my garden while my terrace is at the front of my garden. She would also have less sun in the garden because of the extension of the neighbors. Now the trees have become higher and wider so that I also have little sun in the back of my garden. Last week I even sawed down my own tree in my garden because otherwise I would no longer have any sun in my garden. On these sunny days I can't even enjoy the sun in my own garden after work. because I have little sun in the afternoon and evening hours because of her trees. She can prune these trees very short and every year new branches and leaves grow so that it remains green. I see the same trees everywhere but every year they prune it very short. Help, how can I make sure that I suffer less from this? What rights do I have? How can I convince my neighbor to prune her trees? In my opinion it also does not meet the requirement that these trees must be 2 meters away from the property boundary!! and must have a certain height (not higher than 4 meters?! If consultation with your neighbour does not produce any results, you can let her know in writing that she will prune the branches of the tree and the tree itself so that you will have sunshine again. If she does not do this, you can do it yourself (at their expense). This is only the case if the tree extends above the fence and is within 2 metres of the property boundary.
