Legal advice for marriage and prenuptial agreements
Questioner
Day, My partner has had his own business for 15 years, a sole proprietorship. Due to a legal battle with the landlord of the building because of excessive monthly costs, it is almost impossible to raise money, also due to the recent crisis. There are some outstanding items, but that is nothing and he also pays them off properly and feasible arrangements have been made for them. We have not arranged anything business-wise or privately, now we are getting married in September 2016. We are doing this to have everything arranged properly for the children and if anything happens to us, it is arranged. We have a rental property and a joint account in my name, the car is also in my name. If things go wrong in business, how safe are we privately? Does it make sense to go to the notary before getting married and draw up a prenuptial agreement or are we too late with this? Getting married in community of property or a prenuptial agreement? If we draw up the prenuptial agreement tomorrow, will it only take effect when we are officially married? My specific question is actually, how can we arrange things at home as soon as possible so that I am safe with the children?Lawyer
My advice is that you seek advice from a notary in a timely manner (and that is, given your question, in the very short term and in any case before you get married) and ensure that if you have a prenuptial agreement drawn up (which seems very sensible to me), this is done before you get married.Neem de volgende stap
