Refund for markets: Your rights as an entrepreneur

Questioner

Last May I booked 4 markets/fairs via a website, where I would be present as a small entrepreneur. Paid of course. After asking the municipality, it turns out that these markets do not exist. Contacted the organizer, he admitted it, and he says that I can choose new markets for my money. These are not in the area and these days do not suit me. I am also pregnant and the markets were planned for the next 2 months, do not want to go later because of pregnancy. Asked for money back by phone and email, but no response. What can I do now? Am I entitled to my money back?

Lawyer

Based on your brief story, it seems to me that your counterparty is not fulfilling the agreement and that on that basis you can demand termination with reimbursement of the amount paid.

Lawyer

You do not have to accept placement on other markets. The other party has not fulfilled its obligations under the agreement and can no longer do so, so that it is legally in default, you can terminate the agreement and are entitled to a refund of your money. For more information, you may contact me directly if desired.
