The layout of the kitchen could still be changed up to approx. 8 weeks before delivery. After that it could be ordered definitively. I had to make a deposit of 800.00 euros. The delivery 1.5 years later, kept getting delayed, my private circumstances had changed in the meantime, and as a result I still had not definitively ordered the kitchen. In the end I decided to move and buy a showroom kitchen, which could be picked up immediately and which also fitted much better in my house. But... at another store, because where I had made the down payment, there was nothing in the showroom that I liked. And after finally ordering my kitchen, the delivery would now take 3 months. Have I now lost the down payment of €800.00? Only a drawing was made for me, a cost calculation was done, and nothing was ordered for me. So no further costs were made for me.Lawyer
As you describe it, you have entered into a purchase agreement for the purchase of a kitchen with an associated value. The fact that you have not yet been able to make a final choice does not mean that you are not obliged to purchase a kitchen with the agreed price. I see a conflict arising between you and the first kitchen supplier. If you cancel the purchase agreement, you will be obliged to pay a contractually agreed amount, which is sometimes 30% of the purchase price. A condition such as this is unreasonably onerous and will have to be set aside. In my opinion, you will therefore be out of pocket more than the 800 euros that you now mention.
