Legal Assistance for Hidden Defects
Questioner
Good afternoon, We recently sold our home. The house only has cable (TV and internet via coax). Now the buyers want TV and internet via ADSL. There is no connection for this in the house. Now the buyers want to recover the costs for the connection from us because according to them an ISRA point is legally required. Now I can't find anywhere that this is mandatory. I don't think new-build homes are even delivered with ISRA points as standard anymore. Besides, it's not a hidden defect, is it? They could have checked this before buying. Do we have to pay these costs due to hidden defects? I'd like to hear from you.Lawyer
A hidden defect has to do with the house and the installation of water/electricity and drainage..etc. On the other hand, this information is in the purchase agreement, so it was reported prematurely. The buyers also had a duty to investigate and this was apparently not done. Now that the law states that the seller's duty to report takes precedence over the buyer's duty to investigate, you are legally guaranteed certainty and buyers cannot hold you accountable for this. As far as I know, an ISRA point falls under a luxury of a home and cannot be addressed as a defect of the home.Neem de volgende stap
