Employment law: Can your employer change your position?

Questioner

I work in a call center where I have a different task than calling. They call it a 'growth role'. They described this as: an expert role in which I receive an allowance for the hours worked. I have now done nothing but that expert role for 40 hours for over 8 months, and today I was told that they want to put me back on the phone soon, even though I have a permanent contract. In concrete terms, this means that I will miss out on 300-400 euros per month. Is all this allowed?

Lawyer

If you have worked a certain number of hours for more than three months, you can claim an employment contract with that scope. Unfortunately, your employer is allowed to put you back on the phone. I recommend that if you have another function, you register it. There are arguments for staying in that expert role. I can check your contract without obligation.

Lawyer

The legal presumption regarding the number of hours worked has nothing to do with the content of your position. The following is important with regard to the content of your position: 1. What does your employment contract state? 2. What agreements have been made? 3. What are the reasons for the change of function?; 4. Is the change of function reasonable? The case does not provide sufficient information to answer these questions. I therefore advise you to contact a specialized labor law attorney. He/she is a member of a specialized association. The first consultation is often free.
