Legal assistance with spousal support and co-parenting
Questioner
My ex-partner has had a boyfriend for 1.5 years. He is not formally registered with her but sleeps there at least 4 nights a week. Furthermore, they go on holiday together with our daughter during every school holiday. Daughter has indicated that she wants co-parenting. Ex-partner has indicated to daughter that her boyfriend is not legally a boyfriend but a good acquaintance. Can I prove in any way that the acquaintance is indeed her boyfriend and that this has consequences for partner maintenance? According to the parenting plan, his birthday is even taken into account even if it falls during my holiday. Daughter is then with a boyfriend/acquaintance!Lawyer
If you can prove that your ex-partner lives with her boyfriend/acquaintance 'as if they were married', then the obligation to pay spousal support lapses. If your ex acknowledges the cohabitation, then things should be easy to arrange. However, if she denies it, then you will have to start legal proceedings to have the maintenance obligation terminated. Because you are claiming cohabitation, you will also have to prove this. I advise you to contact a specialist in the field of divorce and maintenance for this.Neem de volgende stap
