In 2014 I got divorced, there is a signed divorce agreement. However, I recently received a letter from my ex's lawyer, in which he indicates that my ex was severely (financially) disadvantaged at the time. This concerns the amount of the buyout sum. My ex is now considering starting legal proceedings. However, she hopes that it will not have to go that far and that we can reach an agreement. Does her case have a chance of success? In other words, can you object to the agreements in a covenant after signing it (and after 2 years)?Lawyer
That seems difficult to me. But it also depends on the content of the agreements and how they were reached. I would have to assess the covenant and the letter to be able to advise you properly.Questioner
Thanks for your response. Can you indicate in general terms on the basis of which situations at the time of signing the covenant, there is a chance that my ex's legal procedure has a chance. The covenant was drawn up by our then lawyers and presented to both of us. My ex was fully legally competent at the time of signing the covenant.Lawyer
I would read the letter from her lawyer to be able to assess the arguments. If you wish, you can email the letter directly to me. I would like to point out that this is no longer free of charge. We have to make a financial agreement about this unless you qualify for legal aid (see: www.rvr.org)Neem de volgende stap
