Legal advice for car purchase problems
Questioner
we made an offer on a car via marktplaats and the seller wanted a down payment so that he would not sell the car immediately. With some reluctance we did this anyway but the car is different than the photos (all saved) show. For example, it seems on the photos that the upholstery is still fine but in reality it is damaged in several places, torn and even sewn together. And when inspecting under the car my husband also saw several defects. We then decided to cancel the purchase. Now the seller does not want to return the deposit. We already had to drive further than his 'home address' because he was working somewhere else. We could not find any reports that this was a fraudulent seller or something, so we went into business with this man in good faith. What can we do to get our deposit of 150 euros back? I have already requested him in several ways to return the deposit.Questioner
It now appears that he cannot have had the car for that long because the last registration is from July 7. He has had a car company since April. According to him, his wife always drove the car with his children but in the communication he indicated that the car was now standing still. So he is very contradictory.Lawyer
You will first have to request the seller in writing to refund the deposit, so that a default arises and you can take legal action. If you wish, you may contact me directly for further information or legal assistance.Neem de volgende stap
