Legal questions about real estate agent management
Questioner
A few months ago I rented out my home through an estate agent. The broker has withheld x amount of annual commission (for management, among other things) from rent + deposit (tenants had transferred it to the broker) and transferred the remainder to my account. Then a few weeks ago I got a message from them that they are going to end management (among other things because it is not profitable for them) and that I have to arrange it myself. I do not get back the commission that they had already withheld for a year. This can't just happen? They can't just decide unilaterally? During the viewing they gave me a contract, I never signed it and they didn't ask for it either. I only had to sign a rental agreement with the tenants. There is no signed agreement between me and the real estate agent. What are my options? Can they refer to their terms and conditions if there is no signed contract?Lawyer
No, that is not allowed. You can reclaim the amount but in any case you are entitled to a pro rata share of the management costs.Neem de volgende stap
