Incorrect use of address for felling permit?
Questioner
The municipality has applied for a felling permit for a tree in our street. They used my address as the applicant. I think this is illegal. I know nothing about it and I find out by chance through a neighbor.Lawyer
I assume they only used your address to indicate which tree it was. So only to determine the correct position. I assume it says something like: near, in front of or at the height of.Questioner
No, they don't. My address is listed under applicant. The tree is not in front of my door, but further down the roadLawyer
Then I would ask the municipality how that is. They might be able to explain how that happens. And what the background might be.Lawyer
The municipality should of course have used its own address, i.e. the address of the town hall. In any case, it is to be hoped for you that the invoice for the fees (and any collection letters) is (are) not sent to the address of the applicant. If still possible, I would raise that error in a formal procedure, i.e. file an objection. Formally legally, the information provided in the application is clearly incorrect.Questioner
