Legal questions about liability?

Questioner

Here is my question: Our 18 year old daughter goes to the beach with her friend, there they decide to go surfing (with a kind of surf board and paddles out to sea, together on a board) my daughter decides not to take her mobile phone on the surfing board, her girlfriend however does take her phone with her! While shopping her friend wants her to take a picture of her, she gets the phone in her hand, the girls wobble a bit and lose their balance., and you guessed it the phone falls into the water and is no longer found in the sea!! Who is responsible now? On whose insurance can this even be claimed?

Lawyer

This is a form of own fault and culpable conduct and that will not be paid/compensated, unless there was intent. But that is not the case, as I read your case. Thus, one will miss the net.
