If the license of an intermediary expires, as can be seen on the AFM website for a company where I have taken out policies, is it then customary for an insurer to inform its insured of this? Last year I already took over the management of an investment account at 1 institution myself because this intermediary was no longer reachable. Now I also have a policy running through another organization and is it customary for an insurer to inform its clients if the intermediary no longer exists? I have also submitted this question to the insurer but have not yet received a response.Lawyer
Insurers have a duty of notification and a duty of care towards the insured. If this is neglected, it is not permissible according to the Wft conduct supervision. If the insurer does not respond, you must write to the AFM. The AFM processes permit applications and exemptions and ensures that, among other things, the Financial Supervision Act (Wft) and the Decree on Conduct Supervision of Financial Enterprises (BGfo) are complied with.Questioner
Very clear. I have also received an answer from the insurer in the meantime. They have also seen that the intermediary's license will expire definitively on October 6. I have now submitted my questions to this insurer. According to them, they have not spoken to this intermediary for quite some time, and they have never received a message about the termination of the intermediary's activities.Lawyer
That is not very nice of the intermediary. On the other hand, I wish you success with the further course of action. Should you have any legal questions in the future, please feel free to contact me directly.Neem de volgende stap
