Legal advice on sickness benefits and unemployment benefits
Questioner
I have been on sick leave for almost 2 years and the waiting period will expire in a few weeks. I was recently assessed; I am not entitled to WIA but I am entitled to more than 1.5 years of WW. Now my boss has been saying all this time that there is no other position available for me within the company, but now my boss wants to let my contract continue dormant after the waiting period, but he has no obligation to pay wages after the waiting period. He does not want to fire me because this entails transition compensation. (I have been working there for more than 10 years) If I find another job after that, I will have to resign, he says. He might want to offer me a new contract for 2/3 of my original hours, but it's not certain yet. A. Is that even allowed? B. If so, am I entitled to unemployment benefits for the remaining hours, even though I have fewer hours on my contract? C. Can I refuse that contract if I don't like the content of the task? D. Even if he does not offer me another contract, but he does not fire me either, can I still apply for unemployment benefits so that I still have an income after the waiting period?Lawyer
Unfortunately, your employer can offer you an agreement for fewer hours. You cannot accept that either. If you have worked more than 26 weeks out of 36, you will apply for unemployment benefits. I have changed employment contracts before.Neem de volgende stap
