Right to unemployment benefits for minors

Questioner

My contract expires next week and I haven't found a new job yet. I am a minor and will be 18 in the first quarter of the new year. Am I entitled to unemployment benefits because I will become unemployed? In principle I meet all other requirements.

Lawyer

A minor aged 16 or 17 is legally competent to enter into an employment contract. In principle, this work applies to them in full (Article 7:612-1 of the Dutch Civil Code). An exception to this is that the employment contract cannot contain a legally valid non-competition clause. Therefore, you are entitled to unemployment benefits, as this is a legally valid agreement.
