Non-competition clause and your rights: Legal advice
Questioner
My daughter did an internship at a hair salon. The owner found that my daughter was very good and versatile with different hair types. Based on that, the owner had her sign an agreement that stipulates that my daughter is not allowed to work within a radius of 15 kilometers from her hair salon for a year. Because according to the owner it has to do with a non-competition clause. My daughter does not plan to open a business and that is why I do not understand it. My daughter has turned down an offer under this agreement because she is afraid she might get into trouble. I think it's nonsense. Can the owner just demand that and make her sign an agreement like that? Is this agreement legally valid?Lawyer
It is a condition to prevent customers who like to be helped by your daughter from going to the next hair salon so that the owner of the first one suffers damage. In principle, such a condition is valid but can be reduced in the given km radius and region. If your daughter works in a large city with many hair salons, then that seems to me a reason to reduce the km radius to 5 or perhaps even less.Neem de volgende stap
