A friend of mine has been working for the same employer for 31 years. Now he became unwell at work and was then briefly ill at home. However, upon his return, he was told that they were going to fire him. He was sent home and was told that he was no longer allowed to contact anyone from the company. In fact, security has been ordered not to allow the gentleman onto the premises and a message has appeared on the intranet for employees about this. So he cannot contact the Works Council or the confidential counselor, if there is one. And he is being treated as a criminal, 31 years for this boss and the reason now is that, according to them, he is not doing his job properly. That cannot be right? He has not stolen anything, threatened anyone or anything and then be treated like this after 31 years of loyal service? He is not eligible for legal aid via the legal aid center because of his income, but a regular lawyer is unaffordable for these people, they are no longer paying and he is at his wits' end.Lawyer
The Legal Desk provides free advice. In addition, there are many law firms that have a (free) consultation hour. Your acquaintance can get (further) information there. If your acquaintance does not qualify for legal aid, it is still a good idea to go to a lawyer. The lawyer is much cheaper than the damage that your acquaintance suffers because of this employer. Often there are also good agreements to be made about (partial) payment. Finally, there are law firms that work on a 'no cure, no pay' basis. However, the quality of such firms is in no way guaranteed. When I read your story, the employer's attitude is very bad. I think that this is not allowed. For that reason, it is good to take action against it as soon as possible. The sooner this problem is solved, the better. Your acquaintance can also do it himself, but experience shows that this is not wise in such cases. If there is a dismissal, the employer must at least pay the transition payment (TV). In the case of a 31-year employment contract, the TV can amount to tens of thousands of euros.Lawyer
