Compensation after a car accident – Rechtswinkel.nl

Questioner

After a collision that was not my fault, my car was declared a total loss. Since I only had third-party insurance, the other party's insurance must pay me the current value of my car. The accident happened more than 5 weeks ago, my car was bought and removed from the damage company more than 3 weeks ago. Despite repeatedly calling and emailing the insurer of the other party, I still have not received any money, and (even more annoying) they refuse to give any indication of when this will happen. I generally get no response to emails, but when I call I am always told that they will 'get back to me soon'. As an entrepreneur, I depend on my car several times a week to do my shopping, for example. At the moment, I incur all kinds of extra costs (such as public transport) to borrow cars from friends and family. I have even been forced to rent a car for a day once. Is there a fixed term within which an insurer must pay out? And is there a possibility to put extra pressure on an insurer, for example by demanding compensation for the extra costs incurred?

As a rule, if liability is acknowledged, then all damages must be compensated. You could claim an advance on the damages. If you wish, you may contact me directly for further information.
