Disability History: Your Rights and Obligations
Questioner
I quote from a letter from Aon on behalf of my employer: What would we like to receive (Disability History) In order to determine whether the inventory has been carried out correctly, we would like to ask you to complete the questionnaire about your disability history. The additional information will only be used for the inventory and has no consequences for your employment contract. As an employer, we may ask questions about your employment history. As an employee, you are legally required to disclose your disability history to your employer upon request. In order to request data from the UWV, we require a signed authorization from you. You will find this authorization in the appendices. Personally, I find this a shady story and, moreover, there is no reference to the law on the basis of which I have to share this data. Am I actually obliged to share this information with Aon and my employer? (By the way, I have never been incapacitated for work)Lawyer
No, you are not obliged to do so. You are certainly not obliged to sign the authorisation for the UWV. When the employer/AON invokes a law, then the relevant article from that law must indeed be mentioned. However, you are obliged, if the employer so wishes, to report after the trial period whether you have received a disability benefit in the past. In certain cases, the employer can, for example, appeal to the 'no risk' policy in the event of a sick report and then he pays less (premium).Neem de volgende stap
