Legal questions about employment contracts

Questioner

Since the last week of August I have been working as a substitute teacher in primary education. I work 3 days. I was never told clearly how long I can stay. However, I saw on my pay slip that I work there until the end of the school year. (July 31) I have not yet received a letter of appointment. I currently have another school in mind, where I could start in about a month. Now my question is... is there a notice period for me?

Lawyer

The maximum notice period for an employment contract is one month. If it is a verbal agreement, the notice period may be shorter. I'll come back to that.

Questioner

Thank you! Nothing was agreed upon verbally. When I asked the director how long I would be staying, he raised his hands in the air in question. The temporary work was done via Randstad, by the way. But I do get paid via the school foundation. The bottom line is that colleagues expect me to be there all year round, but I don't get a clear answer from management. Only my pay slip shows that I will be there until July 31st. I'd like to hear it.

Lawyer

If you resign from the school now, you cannot be required to work there later than November 1st. In order not to be bound by the agreement with the employment agency while you work elsewhere, I advise you to take that agreement into account. Depending on the agreement, a notice period of one month applies. I've looked into something like this before.
