My question is: When a municipality has signed a management agreement, can it be declared null and void if circumstances have changed dramatically? In short: Is a municipal management agreement always irreversible or does such an agreement take into account circumstances that may change?Lawyer
Unforeseen changes in circumstances may be a reason why a party cannot be expected to fulfil an agreement (unchanged). Force majeure may also be a reason why an agreement does not have to/cannot be fulfilled. If the parties are unable to reach a solution by mutual agreement for the consequences of the changed circumstances, a party may apply to the court to determine whether there are such unforeseen circumstances that unchanged performance of the agreement cannot be required.Neem de volgende stap
