Legal advice for rental problems

Questioner

My daughter (student) who is seriously ill (kidney failure) has been renting a studio apartment in Rotterdam since 01-01-2015 for a rent of 778 euros. This amount includes an advance payment of 100 euros for the use of gas, water and electricity. And an amount of 30 euros for service costs. According to the agreement with the tenant, the advance payment would be settled at the end of the year. Because this did not happen, we asked the landlord to do this. We did not receive the statement until the end of June 2016. The conclusion was that an amount of 954 euros too much had been paid. After our objection, they indicated that they would deduct an amount of 479 euros. Subsequently, an amount of 475 euros was entered for the use of electricity in the common area. Nowhere in the rental agreement is this cost item mentioned, which simply appears to be a hidden item. We spoke to the landlord about this and he stated: I am going to give you money so that you can move. then withdraws and drops the story with the hired property manager. The costs of electricity in the living space are almost equal to the listed item electricity common space. What can we do about this.?

If one rents a room in a student house with an advance and not further specified (for example in common areas), then one may not come with that bill afterwards. The rent is supposed to include all areas. Furthermore, I wonder if multiple rooms are rented and if so, if an intermediate meter has been placed in the common area, otherwise it will be a difficult calculation.

Questioner

Thank you for your response. In the building there are 14 residential studios these are independent living spaces that all have their own gas water and electricity meter There will be a main meter but it is not accessible to the residents. There is no intermediate meter The common area is the entrance hall the stairs and the landing. The lights are linked to motion detectors. And electricity energy is used when you enter or come into the building. Several residents use the passage. Especially the fact that they are now coming up with this hidden cost item and the absurdly high amount in my opinion is the reason for me to submit this question.

Yes I agree with you that the amount claimed is too high when divided by 14? You should ask for a calculation because it is not correct.
