Legal assistance with camper problems
Questioner
4 weeks ago I bought a second-hand camper via Marktplaats (built in 2000, €18,750). According to the seller, this camper was in good condition and could certainly be driven with pleasure for years to come without abnormal maintenance. The camper was MOT tested just before purchase. Apart from a light, no problems or points of interest emerged from the MOT test. Now, 4 weeks later, it turns out that the camper should never have been approved. Various rotten spots in the chassis and a number of other major problems that require major maintenance before it can safely hit the road again. In addition, there is so much rust in and on the chassis and sheet metal (underside) that thousands of euros worth of major maintenance will have to be carried out in the coming year. The seller says he knows nothing about it. The MOT inspector should have registered the majority of the major problems as points of attention and/or rejection. If we had known this, we would of course never have bought the camper.Lawyer
In general, with a second-hand item, one must take more account of defects, whether or not hidden. The buyer has a duty to investigate, the seller a duty to inform. If the seller has stated that the chassis is good and you had no reason to doubt, you can cancel the purchase due to non-conformity, or unilateral or mutual error. The price you paid also plays a role (considerably less than on the regular market? no, right?). Without the help of a lawyer, I fear this will be difficult. I can help you well on your way in the process from letter to summons (if necessary).Neem de volgende stap
