Information about Liability for Cable Damage

Questioner

Hello, I have the following question. I have a snack cart. We get our power via a connection from the municipality. We roll out a power cable for this. This cable apparently ended up around/behind a tow bar. The owner of this car tore the power cable apart when driving away from a parking space. The driver does not want to pay because he thinks that we should have made sure that the cable could not hinder the car in this way. Apparently the cable slid off a bush. That is not known. Can the driver now be held liable for a new power cable? He does not want to arrange anything. There are only witnesses who heard the driver say that he tore the power cable apart. No one saw the incident happen. What are my chances?

You have the duty to clearly indicate that there is a cable running across the road. That this was taken by the motorist due to circumstances is an unforeseen circumstance and you cannot blame the motorist because there is no intent involved.
