Repair damage caused by a neighbor
Questioner
After my brother's verbal permission, the neighbour built a shed onto my brother's. Since then, there appears to be tension on my brother's house, resulting in more and more cracks in his walls. Of course, my brother would never have given permission if he had suspected that it would cause him damage. The neighbour denies that the cracks are and will continue to occur as a result of the extension. What options does my brother now have to recover damages that have occurred and prevent future damages? Perhaps of interest: the house is not in the Netherlands, but just across the border in Germany.Lawyer
Your brother can summon the other party. In the procedure he will have to prove that the cracks are indeed a result of the extension of the shed. If he succeeds, he can claim both damages and the removal of the cause of the cracks. If the case concerns an interest of more than €5,000, he is obliged to have a German lawyer. In the event that he wins the case, he can - if he has summoned the other party in advance - reclaim both the legal costs and the court fees.Lawyer
German law applies and a German court will have jurisdiction. So it will be necessary for your brother to hire a German lawyer and discuss with him what is going on. We are happy to help!Neem de volgende stap
