Legal advice on dismissal and notice period

My (2nd) contract expired on September 12, my employer (no collective labor agreement) was too late to indicate whether my contract would be extended or not. In the meantime I have found another job and will start with the new employer on October 10th. Now my old employer says that I cannot simply resign and that I must adhere to the 1-month notice period, even though September 12 is my last working day. Former employer threatens legal action and demands that I finish my month and pays a fine. How do I get out of here?

If the employment contract does not contain a notice period, it will end by operation of law and you will be free after that, unless you reach an agreement with your employer about the continuation of the employment contract. If your employer has not informed you in time what he wanted to do with this employment contract after it has expired, he will owe you compensation for every day that he was late.
