Legal Aid: Cancellation of dance lessons and payment obligation

Questioner

When I registered for my dance class, I signed up for two lessons (per week) this season. Now, one of these lessons appears to be too difficult for me and I no longer want to follow it. Because the season has already started (I went twice to try it out), I can no longer cancel that one difficult lesson. They want me to follow another lesson, but the other offer they have is not interesting to me, or is on days when I have other obligations. The terms and conditions on the site consist solely of these sentences: - One is committed to the entire course. - After registration via registration card or email, payment of the full tuition fee is mandatory. - Cancellation is only possible before the start of the new season by registered letter. My question now is, can they force me to pay for the entire season (two lessons per week)? While I only take one lesson per week?

Lawyer

These terms and conditions are unreasonably onerous, as the condition completely and unconditionally deprives the other party of the right to fully demand the promised performance. Among other things: You as a user cannot avoid your obligations. And that is unreasonably onerous. Conditions that are on the so-called blacklist are by definition voidable. So even when you and the other party agree that you both find those conditions entirely reasonable (art. 6:236 BW). If you wish, you may contact me directly for further information.
