Subletting and agreements: What are your rights?
Questioner
I have a roommate who sublets part of my house from me. We never drew up a contract. I rent the house again from the housing association. One of their conditions is that the house cannot in principle be taken over by my housemate. I communicated this via whatsapp at the time. He responded by asking how long I expected to stay. I replied: A year (or until summer 2017). He responded: I think I will. (later he did indeed) Now my plans have changed. I want to move asap. However, he comes with the above whatsapp conversation which according to him is a legally binding agreement that I stay for a year and he demands from me that I stay in the house until June. I think this is nonsense. After all, the word expect was literally used. And because everything was still so vague and uncertain, there can be no question of a binding agreement? But I would like to know for sure instead of following my lay intuition.Lawyer
There is a binding agreement, but you are now subletting your home under the landlord's terms. So there are two problems.Neem de volgende stap
