I am now 59 and was declared redundant as of November 1, 2012. I was entitled to 38 months of unemployment benefits, until December 31, 2015. My girlfriend is now 55 and was also declared redundant as of 31 December 2014. She was entitled to 36 months of unemployment benefits, until 31 December 2017. We both stopped our benefits prematurely in September 2015 to look for work abroad. After 8 months we returned to the Netherlands because we had not been able to find work. The IOAW application states 'have you completed the maximum unemployment benefit period and was the duration more than 3 months'. For both of us, the answer to the first question is no and the answer to the second question is yes. Are we entitled to IOAW benefits because we both stopped our unemployment benefits prematurely?Lawyer
You have cancelled your unemployment benefit yourself, which means that you have not completed the maximum unemployment benefit period. As a result, you cannot claim an IOAW benefit. Because you have lived abroad for more than six months, you cannot claim a revival of the unemployment benefit. You can therefore at most claim under the Participation Act (social assistance).
