Questioner

I am the heir of a small bungalow of my deceased friend. To cover the costs I have been renting it out for a number of years, including the furnishings and the companies in service. Recently a young man lived there for 5 months, who asked when he moved into the house if he could store my friend's belongings in storage. I indicated that it should not be a problem if he left everything in the same condition when he left the house, as described in the rental contract. He said he would take care of that, but a month before he gave notice he asked me on the phone if he could get rid of the couch and the mattress because it was old and he could give notice of his storage. I said he could and he sent me an email that he was happy with the conversation and that he would throw away the furniture... to which I had written in full confidence ..fine.. When the house was delivered I discovered that he had thrown away everything except a cupboard bed and dining area 2 plates and 2 frying pans and he referred to the email and asked for his deposit back... (1 month's rent) I told him that I would first look at the damage and that he would hear from me. But the damage was enormous and I had to buy a new vacuum cleaner / kettle / coffee maker / microwave / iron and the entire kitchen equipment because the next tenant had of course also rented that inclusive. Now my question is, do all those appliances also fall under furniture? He now wants to get a lawyer on it, hence my question ... kind regards ps not only that it is a financial blow but also a very sad one..

Of course, the tenant may not just throw away all your stuff. You may keep the deposit until the dispute is resolved. Since I cannot see what the email exactly contains. Therefore, I request that you contact me directly for further information.

From the email I understand clearly that they are asking whether the rest of the furniture can be thrown away. You respond, with fine and if there are other usable things in the kitchen that they should be put in a box. In this way you give permission to throw away the remaining furniture. Unfortunately.
