I asked the employment agency I no longer work for if I could get a copy of my contracts. They don't want to give them because I had a copy in the past when signing the contract. I accidentally threw it away. The only way I can get my contracts according to them is by order of a judge. I wonder if it is true that they only have to give it this way. I also wonder how long they have to keep contracts. Thanks!Lawyer
Based on article 35 of the Personal Data Protection Act, you are requesting access to the personnel file. Your agreements are also included in this file. You are also entitled to a copy. I will be happy to call the employment agency for you.Questioner
Is it also possible for the company I worked for and that hired me through the employment agency to request my contracts? Or are they not allowed to provide them because it concerns an agreement between me and the employment agency?Lawyer
Your former employer must also have a personnel file. It is a different contract than that of the employment agency. The agreement you want to request, you request by submitting reasons based on case law.Neem de volgende stap
