Assistance with damage after a collision - Legal Aid

My son was hit by another car. The damage report has now been drawn up. However, the insurance company will not pay out because the party that hit us has not submitted his damage report. This appears to be a car from a leasing company that was rented out. The leasing company does not know the details of this person. We have now passed this on, as he did fill this in on our damage form and indicated that he was at fault. What should we do now? It is a company car. Since my son has his own company. The insurance company has indicated that we are not allowed to claim the costs of a rental car. My son needs the car for his work. He also has no money to advance the car, that is what the insurance company says.Lawyer
I am sorry to hear that the handling of the accident is not going smoothly. The other party has admitted guilt. This is often an indication that liability will be settled and that the damage will be compensated, but it is not a guarantee! The insurer will make an independent decision about liability. That is why they have also asked their insured for a claim form. Even if their insured does not respond, liability can still be established, for example if the claim form has been signed by both parties and/or there are witnesses who can make a statement and/or if the police have been present at the accident and have drawn up a report. This often takes a while and the settlement of the case can take a few weeks to a few months. Especially if a leasing company is involved, my experience is that this can take a long time. Regarding the rental car, the following. Unfortunately, your son cannot rent a car indefinitely. As an injured party, your son is obliged to limit the damage, so he must keep the rental period as short as possible. In the event of repairs, this is the time needed to repair the car. If the car is a total loss, 14 days' rental is usually reimbursed. Sometimes personal circumstances are taken into account. For example, if the car is hit just before a car holiday, the rental car will be reimbursed during the holiday. If there are special circumstances, your son can object and request a longer rental period. Good luck!Lawyer
There are a number of things you can do. 1) Send the completed accident damage report form to the insurer yourself. Especially if you have completed and signed it together with the person who caused the accident. 2) The leasing company says they don't have the person's details. That's not really necessary. The car is insured (not the person who drove the car). So they know exactly who to report the accident to in order to get the costs reimbursed. 3. A rental car is usually reimbursed at 75% for 14 days (exceptions notwithstanding). Success!Neem de volgende stap
