Legal assistance with debt collection and refunds
Questioner
Hello, I bought a product on a Dutch website a while ago and so did my boyfriend. Now I admit that I was late with the payment, but I paid the amount including the reminder costs. This for me and for my boyfriend. 5 days later I receive another text message with a last chance to pay, but this for 1 of the two. I then check my transfers and see that an amount that does not correspond to the transferred amount (€46.47 received and €58.49 transferred and the product originally came to €49.49) has been deposited into my account by the company where I had ordered? I then send them an email asking why I have received money that I cannot figure out the amount of and what I still have to pay to settle this. A week later I receive an email back saying that this is probably a payment with an incorrect message since a refund has been made and that I have to settle it with a collection agency, because it was transferred to the collection agency the day before their email with the answer to my question! Then I check the message and it is correct! I also tell the collection agency this story (with proof of transfers and email traffic). I also get the answer from them that it is an incorrect transfer and that it cannot be linked in their system. And the claim remains upheld and I therefore also have to pay the €40 collection agency costs on top of the cost of the product of €49.49! But no one explains to me why I only get an amount of €46.47 returned on an amount of €58.49 that I paid! Can this just happen and all this simply by email, because no letter has been sent by post here? Yours sincerely,Lawyer
You have paid in good faith, the price plus the costs. If you do not agree with the refund, you should not accept it and state that you have already paid the claims and refund. Done. It is not in your sphere of risk that there is a bad, non-functional administration on the seller's side.Neem de volgende stap
