On Sunday evening I was having a nice time in a café. While I was smoking outside, a very good friend of my father-in-law was grabbed by the throat and beaten inside because he made a comment about a headscarf. I wasn't there myself. The man had to go to the ATM to pay the bill and when he came back I was still standing outside with my father-in-law. My father-in-law wanted to get the story straight by asking in a very normal way what had happened, but the man was not happy about it and started hysterically hitting the window of the café. When my father-in-law tried to stop him, he grabbed my father-in-law by the throat and my father-in-law had just returned from the hospital a few days ago because he has cancer in his throat and punctures had been performed 2 days before. I was shocked and I believe he grabbed the man by the head and threw him to the ground. The man landed wrongly and broke his hip. I did not hit or kick him. I am now so afraid that I will be charged with serious assault while I did not mean it at all. I was so scared that my father-in-law was grabbed by the throat. My question is whether I am right to be concerned or whether I am worrying about nothing.Lawyer
You are right to be concerned. Now that the person who grabbed you by the head has fallen to the ground and broken his hip, it is customary for the police to conduct further investigations and submit the case to the Public Prosecutor. So you run the risk of prosecution, or at least of being questioned. Perhaps it would be wise to consult a lawyer beforehand if you are invited for questioning.Questioner
Yes I still have to give a statement about what happened but it was not intentional I just wish he would let go of my father in law's throat What can be my punishment for this? I have no criminal record and have never been convicted of anything. And that man is also punishable because he grabbed 2 people by the throat, isn't that attempted manslaughter?Lawyer
If you still have to make a statement, it is most likely an interrogation as a suspect of a criminal offense. This internet site is not intended and is also not suitable to give you good substantive advice on what is sensible. I therefore advise you to talk to a lawyer before you make a statement, who can give you tips on what you should and should not say.Neem de volgende stap
